Auch dies wieder als kurioses Beispiel für Verfahren, die eben nur in den USA möglich sind. Dennoch nichts, was den deutschen Unternehmer schrecken sollte… Aber lesenswert, immerhin hatten sich 8 Bundesstaaten an der Klage gegen fünf  US-Energieunternehmen beteiligt. Die Klage wurde in 2005 abgewiesen, das Berufungsverfahren läuft.

US-Staranwälte haben gemeinsam mit den Generalbundesanwälten von acht Bundes-Staaten eine Klage gegen fünf große Energieversorgungsunternehmen eingereicht.  Sie fordern Einschränkungen der Emissionen des Treibhausgases Kohlendioxid. Derzeit diskutieren Experten, ob diese Taktik zu einer langsameren Klimaerwärmung beitragen wird. Das berichtet das Wissenschaftsmagazin Nature http://www.nature.com.

Die Anwälte haben die Klage bei einem New Yorker Gericht eingereicht. Die fünf beklagten Unternehmen sind für zehn Prozent der gesamten Kohlendioxid-Emissionen der USA verantwortlich. Das Verfahren fällt unter das Gesetz des „öffentlichen Ärgernisses“, das in den USA für Umwelt-Fälle, wo es um die Beschränkung von Luft- und Wasserverschmutzung geht, herangezogen wird, weil es eine Bedrohung für die Öffentlichkeit darstellt. Das Anwaltsteam argumentiert dahingehend, dass die globale Erwärmung unzählige zukünftige Risiken in Bezug auf Lungenerkrankungen, Hitzeschläge, Fluten, schrumpfende Eisschichten und die Bedrohung von Wildtieren darstellt.

Die Anwälte fordern die Unternehmen auf, ihre Kohlendioxid-Emissionen durch den Umstieg auf sauberere Treibstoffe und umweltfreundlichere Technologien um mindestens drei Prozent pro Jahr für die nächsten zehn Jahre zu reduzieren. „Es ist klar, dass wir handeln müssen“, so Eliot Spitzer, Generalbundesanwalt von New York, bei einer Presskonferenz. Die Anwaltsgruppe gab als Grund für ihr Handeln das Versäumnis der Regierung an, die Produktion von Treibhausgasen einzuschränken. Die Regierung Bush hat freiwillige Reduktionen favorisiert, statt diese gesetzlich zu verankern.

Beobachter bezweifeln jedoch, dass ein Gerichtsverfahren der beste Weg ist, eine Reduktion der Kohlendioxid-Emissionen zu erreichen. Es wird Aufmerksamkeit erregen, „aber keinen Unterschied machen“, so Eileen Clausen vom Pew Center „globaler Klimawandel“  . Eines der beklagten Unternehmen, American Electric Power in Ohio, hat sich schon bereit erklärt, seine Kohlendioxid-Ausstöße bis 2006 um zehn Prozent zu reduzieren. Eine Sprecherin des Unternehmens sagte, eine Klage einzureichen sei kein konstruktiver Weg um dem Klimawandel zu begegnen.

Das Anwaltsteam vergleich den aktuellen Fall mit den Verfahren gegen die Tabakindustrie, in denen die Unternehmen für die Gesundheit von Rauchern verantwortlich gemacht wurden. Wenn die Kläger gewinnen, werden auch andere Unternehmen gezwungen ihre Emissionen von Treibhausgasen zu reduzieren. Aber einige Anwälte, die auf Umweltfragen spezialisiert sind, argumentieren, dass es schwierig sei, nachzuweisen, dass die globale Erwärmung einen spezifischen Schaden an Menschen und Umwelt verursacht.
