Pending before us are (1) plaintiffs-appellees` („plaintiffs“) motion for a 30-day extension of time to file their responsive (red) brief and appendix; (2) defendants-appellants` („defendants“) motion to stay all proceedings in the District Court pending resolution of their appeal; (3) defendants` motion for an expedited appeal; and (4) plaintiffs` motion to dismiss the appeal as untimely and non-final. We resolve those motions as follows: (i) Plaintiffs` motion for an extension of time is GRANTED, but filings will be made in accordance with the schedule set forth in this Order. (ii) Defendants` motion for an expedited appeal is GRANTED, and the appeal will proceed as follows: (a) Plaintiffs` brief and appendix will be filed on or before October 14, 2009. On June 25, 2009, defendants in the above-captioned case filed a notice of appeal in the United States Court of Appeals for the Second Circuit, seeking interlocutory review of this Court’s April 8, 2009 Opinion and Order granting in part and denying in part defendants‘ consolidated motion to dismiss these actions in their entirety. On June 30, 2009, defendants wrote to the Court asserting that the Court had been divested of jurisdiction on the basis of defendants‘ appeal or – in the alternative – requesting that the Court enter a discretionary stay pending resolution of defendants‘ appeal. „Appeals under the collateral order doctrine do not generally divest the district court of jurisdiction over issues not under consideration in the appeal.“ An exception to this principle is the dual jurisdiction rule, which divests a district court of jurisdiction immediately upon the filing of a request for interlocutory review under the collateral order doctrine only in cases „respecting a right not to be tried,“ such as double jeopardy, foreign sovereign immunity, Eleventh Amendment immunity, and qualified immunity. Political question and comity concerns do not convey formal immunity from suit. Therefore the dual jurisdiction rule does not apply, and this Court retains jurisdiction. This case has been pending for over seven years. That alone is a sufficient basis for this Court to deny a discretionary stay while defendants‘ interlocutory appeal is pending. 06/22/2009 111 MEMORANDUM OPINION AND ORDER # 97678. Over forty years ago, the New York Court of Appeals took heed of the plight of a foreign corporation sued in the United States, using words that remain accurate today: „I are not unmindful that litigation in a foreign jurisdiction is a burdensome inconvenience for any company. However, it is part of the price which may properly be demanded of those who extensively engage in international trade. Plaintiffs have not yet demonstrated that Rheinmetall is subject to suit in this Court. However, they have made a sufficient showing to convince this Court that the best course is to undertake jurisdictional discovery, so that this Court may make a final determination concerning personal jurisdiction on a full evidentiary record. For the foregoing reasons, Rheinmetall’s motion to dismiss is denied with leave to renew at the close of jurisdictional discovery. Plaintiffs‘ motion for authorization of an alternative form of service is granted. Plaintiffs are ordered to serve counsel for Rheinmetall personally within sixty days. The deadline for Rheinmetall to move to dismiss or answer the Complaint remains stayed until after resolution of the renewed motion to dismiss for lack of personal jurisdiction. 06/16/2009 104 ORDER On May 27, 2009, this Court denied defendants‘ motion for certification of an interlocutory appeal of the April 8, 2009 Opinion and Order granting in part and denying in part defendants‘ motion to dismiss. Defendants now move for reconsideration. In a footnote in the May 27 Opinion and Order, I wrote, „If defendants are suggesting that plaintiffs could have brought this suit in South African courts, defendants failed to raise such forum non conveniens or exhaustion arguments in their motion to dismiss and have now waived them. In the context of a motion under 28 U.S.C. § l292 (b), this statement denotes waiver of this argument as a ground for certification for interlocutory appeal of the motion to dismiss. To be perfectly clear, these affirmative defenses are not waived as a general matter. Nevertheless, should defendants intend to move for dismissal on forum non conveniens or exhaustion grounds, they must do so at the soonest reasonable time. 06/08/2009 99 ORDER. On April 8, 2009, this Court granted in part and denied in part defendants‘ motion to dismiss plaintiffs‘ Amended Complaint. In the April 8 Opinion, this Court dismissed plaintiffs‘ claims against IBM, Daimler, GM, and Ford on the basis of insufficient allegations concerning vicarious liability. In the same Opinion, this Court denied defendants‘ motion to dismiss claims made by a second group of plaintiffs – the Ntsebeza plaintiffs – against those same companies. Thus this Court granted the Balintulo plaintiffs leave to amend their complaint in order to supplement their allegations. On May 19, 2009, defendants IBM, Daimler, GM, and Ford moved to dismiss plaintiffs‘ Second Amended Complaint. In the April 8 Opinion, this Court stated, If the allegations in the amended [Balintulo] Complaint are similar to those made in the Ntsebeza Complaint, the outcome of any motion to dismiss will be the same. Although I recognize defendants‘ need to preserve their objection, this need not be done through extensive briefing. The allegations made in the Second Corrected Balintulo Complaint concerning the agency relationship between defendants and their foreign subsidiaries are in fact identical to the allegations contained in the Ntsebeza Complaint. Therefore, for the reasons stated in the April 8, 2009 Opinion and Order, defendants‘ motion to dismiss is denied. 04/08/2009 61 MEMORANDUM OPINION AND ORDER # 97390. What remains of these consolidated cases is vastly different from the dozen actions first filed in 2002 and 2003. Corporate defendants accused of merely doing business with the apartheid Government of South Africa have been dismissed. Claims that a corporation that aided and abetted particular acts could be liable for the breadth of harms committed under apartheid have been rejected. What survives are much narrower cases that this Court hopes will move toward resolution after more than five years spent litigating motions to dismiss. For the foregoing reasons, defendants‘ motion to dismiss is granted in part and denied in part. Plaintiffs‘ motion to re-solicit the views of the Governments is denied. The following claims remain: Ntsebeza plaintiffs against Daimler, GM, and Ford for aiding and abetting torture, CIDT, extrajudicial killing, and apartheid. Ntsebeza plaintiffs against IBM for aiding and abetting arbitrary dentationalization and apartheid. Khulumani plaintiffs against Rheinmetall for aiding and abetting extrajudicial killing and apartheid. The following claims are dismissed with leave to amend: Khulumani plaintiffs against IBM and Fujitsu for aiding and abetting apartheid. Khulumani plaintiffs against Daimler, GM, and Ford for aiding and abetting extrajudicial killing and apartheid. All other claims are dismissed with prejudice, as any amendment would be futile. The Khulumani plaintiffs may file an amended complaint by May 1, 2009. The stay concerning Rheinmetall Group’s objections to the exercise of personal jurisdiction and to improper service of process under the Hague Convention is now lifted, and Rheinmetall may file a motion to dismiss on those grounds by May 1, 2009.
