Produkthaftungsklage am U.S. District Court,Western District of Tennessee (Jackson),CIVIL DOCKET FOR CASE #: 1:09-cv-01189-JDB-egb, gegen unter anderem die Lavatec GmbH Heilbronn, die aber nach Klageerhebung in 2009 in die Insolvenz ging, eine Zustellung war allerdings in Deutschland gegen die GmbH noch nicht erfolgt. Das Gericht fragt nun an,wie die Parteien weiter vorzugehen gedenken und verlangt im übrigen Nachweis der Insolvenz. Lavatec‘ Assets (u.a. Patente / Marken / Anlagevermögen) wurden aktuell an einen neuen ehemaligen Vorstand der Läpple AG verkauft. Siehe auch www.stimme.de/heilbronn/wirtschaft/art2088,1852685. Es bleibt abzuwarten, ob sich hieraus noch Folgen für den neuen Eigentümer ergeben. Man wird aber davon ausgehen können, dass der deutsche Insolvenzverwalter und der deutsche Erwerber eventuell bestehende „Durchgriffsansprüche“ geprüft und Vorsorge getroffen haben. Inwieweit eine Verflechtung zwischen der (ebenfalls in Insolvenz befindlichen) US Lavatec, Inc und der deutschen Lavatec besteht (anders als über den dahinter stehenden Gesellschafter Herrn Tadros) kann der Blog nicht beantworten.
