Workers’ Compensation for Injured Employees In every state, employers must provide workers’ compensation benefits to employees who are injured during the course of their
employment. These benefits are typically provided through private insurance that the employer obtains at or before the time employees are first hired. The cost of the insurance is determined by factors such as the size of the employer’s payroll, the nature of the business (for example, construction, manufacturing or office work) and the employer’s prior record concerning benefits paid to injured employees. The benefits that injured employees receive are set by law. The benefits are the employee’s sole remedy for workrelated injuries or illnesses, and employees may not bring court claims against their employers for additional benefits.
