Juni 2010 — Speaking on the Senate floor, Sen. Tom Coburn rejected the judicial philosophy that embraces the use of foreign law in interpreting the U.S. Constitution. Dr. Coburn also pointed out that while then-Judge Sotomayor agreed during her confirmation hearing that foreign law should not be consulted in our courts, she explicitly cited it during a recent Supreme Court opinion. As a result, Dr. Coburn said, Senators can no longer simply rely on nominees‘ statements made during hearings.
